Hot off the Press: The IRS has passed a Ruling that says a married same-sex couple, who was legally married in a state that recognizes this marriage, WILL be treated Married for all Federal tax purposes. This means they can file a joint married income tax returns and take advantage of the unlimited federal exemption for estate taxes of a married couple. It does not matter if the couple moves or currently lives in a state that does not recognize same-sex marriages. The law also provides that the couple can AMEND their previous federal returns. This is a hot area of law right now. We’ll keep you posted on more developments as they arise. Krueger Hernandez & Thompson SC believes EVERYONE needs an estate plan.
