In Wisconsin, amazingly all you have to be worth to have to go to Probate is over $50,000. If you die owning assets in your own name and there is no beneficiary listed on that asset to receive it at your death, your estate must go through the death probate process. This process is done through the probate court and on average takes 9 to 24 months to complete. At a minimum it will take 3 months just because there is a legal requirement to give your creditors at least 3 months to file a claim against your estate. This is done through the “Notice to Creditors” document and must be published in the newspaper. There are some things you can do to avoid the probate process.
