Wisconsin Personal Injury Law: How much is my Case Worth?

Stephanie Thompson, Estate Planning Attorney of Krueger Hernandez & Thompson SC · Jan 15, 2014 ·

If you feel you have a personal injury case, the first step to take is simple: contact a personal injury attorney who can review the finer details of your situation and determine how to best move forward.

Soon enough, you will better understand more about your situation including whether or not you have a case. If you do, your attorney will explain the steps that need to be taken. An experienced attorney will also be ble to answer the question of how much your case is worth based on past results in the courtroom.

There is no simple way of valuing a personal injury claim. For this reason, an experienced and knowledgeable attorney who has represented clients in your position in the past is very important to your case.

Here are some of the many factors that go into determining how much your case is worth:

  • Who was at fault?
  • What is the extent of your injuries?
  • Your age
  • How your injuries impact you now and how could they affect you in the future
  • Has your income status been affected?
  • Does the at-fault party have insurance?

These are the types of factors that go a long way in determining how much your case is worth. For example, a serious injury that will affect your long term ability to work will be worth more than one in which you only had to miss a couple of weeks on the job for treatment.

The amount of money you receive for your case is dependent on the damages of your case. Generally speaking, there are two type of damages that you can seek:

  • Compensatory damages
  • Punitive damages

Compensatory damages are also referred to as “actual damages.” This is intended to provide compensation for the actual damages suffered. For example, if you have been involved in a car accident these damages could include: lost wages, medical bills, and damage to your vehicle.

Punitive damages, on the other hand, are based on the nature of the injury and are often awarded when compensatory damages are not an adequate solution. Punitive damages are not meant to provide the plaintiff with more money but instead punish the defendant for his or her actions.

Nobody wants to file a personal injury lawsuit, but if you find yourself in this situation it is best to hire an experienced attorney who can review your case and determine how much it is worth. Krueger Hernandez & Thompson SC levels the playing field for you so you can receive the compensation that you deserve.
