We’ve all heard the saying that became something is on the internet, it must be true. The joke applies to all media. I have been representing injured victims of the negligence of others for more than 27 years. Over the years, big businesses, insurance companies, etc., have attacked our tort system claiming that Plaintiffs and their attorneys are ruining our country. The claims have been many and are filled with misstatements and never state both sides of the story. Have people filed frivolous claims? Of course, and state as well as federal laws have implemented protections and penalties against those who file frivolous claims. However, we are not talking about frivolous claims but are talking about claims where people are seriously injured.
The latest is Blitz USA. Apparently, they make gas cans and are claiming they are closing because of unwarranted products liability litigation. The conservative media is claiming that lawyers are putting them out of business because of what amounts to be frivolous claims yet I am unaware of there being any finding of any of the claims against being frivolous.
It is my understanding (just because you are reading this on the internet does not make it true) is that there have been between 50 and 100 people burned by Blitz gas cans and further it is my understanding that many of those were children. Apparently, the injuries could have been prevented if the manufacturer installed a flame arrester that is claimed to have cost less than $1. Apparently, other gas can manufacturers use it but for whatever reason Blitz did not. It seems to be a simple solution to a rather horrible problem and doesn’t seem to have a relationship to the real cause as to why this company is going out of business if in fact they truly are.
Again, I am repeating what I am hearing and invite others to comment. I have not represented anyone claiming to have been injured by a Blitz gas can. I know very little about Blitz but do know that there are always two sides to a story. If they are claiming they are going out of business because of lawsuits then one has to question why not make a safe gas can and not worry about lawsuits? The answer seems obvious.

There is always an exception but perhaps manufacturers and big businesses need to accept responsibility for their actions and if those actions are causing injuries to others, modify their practices and compensate the injured. That is truly the American way!
