If Wisconsin Has a 3 Year Statute of Limitations, Do I Need to Hire a Personal Injury Attorney Soon After the Accident?

Yes, Wisconsin does have a 3 year statute of limitations which, in most negligence cases applies. However, in some cases, depending upon the theory of the case, a different limitation period may apply which could be less than 3 years. This is one reason to hire an attorney as soon as possible so you do not miss any deadlines. Another reason is that the sooner an attorney gets involved the sooner the investigation can be conducted and completed. The accident site can be photographed and investigated before it is changed. Witnesses can be contacted, interviewed and statements taken before they disappear or move never to be found or heard from again. Police officer can be interviewed while the accident is fresh in their minds. Medical records can be obtained and reviewed to address concerns such as pre-existing conditions or incorrect references in the records which may ultimately impact your case. Discovering all applicable insurance is often times much easier shortly after the accident then it is a year or more after the accident. Filing suit before your approach the statute of limitations is beneficial because it avoids situations where you omit to name a responsible party either because the identity of the party is unknown or other reasons which ultimately may prevent you from recovering damages. The reasons for hiring an experienced attorney as early in the process as possible is unlimited and can only help you better recover the damages that you are legally entitled to receive.
