WISCONSIN PERSONAL INJURY LAW: IF I HAVE ANYTHING TO DO WITH CAUSING THE ACCIDENT CAN I STILL RECOVER DAMAGES EVEN IF THE OTHER DRIVER ADMITTED TO CAUSING THE ACCIDENT?

Stephanie Thompson, Estate Planning Attorney of Krueger Hernandez & Thompson SC · Oct 22, 2013 ·

In most accidents, more than one driver contributes to causing an accident.  Determining the degree of responsibility is a big part of resolving an accident claim.   If you are in an accidnet and the police officer said the other driver admitted to not seeing you when he pulled from the stop sign and caused the crash, you still might be partially to blame.   In Wisconsin, we compare the responsibility (negligence) for causing the accident to all drivers.  If the injured driver is more than 50% responsible there is no recovery.  For any driver that is less than 50% the damages are reduced by the percentage of responsibility.  For example, if the other driver is 90% at fault and you or a loved one are 10% the court would reduce your damages by 10%.  Again, it is very complicated and often times prompt representation can result in obtaining and protecting the evidence used to prove responsibility.

If you, a friend or family member have been injured in a car or any other motor vehicle accident, please contact me for a no cost, no obligation consultation. I take these cases on a contingency fee basis which means there are never any fees unless and until we recover. I have been representing victims injured by the negligence of others for more than 28 years and would be glad to help you with your injured claim.

Please feel free to contact me in the Madison area at (608) 824-9540, in the Dells area call our Baraboo office at (608) 356-3961 or statewide at (866) 455-2993.
