In most accidents, more than one driver contributes to causing an accident. Determining the degree of responsibility is a big part of resolving an accident claim. If you are in an accidnet and the police officer said the other driver admitted to not seeing you when he pulled from the stop sign and caused the crash, you still might be partially to blame. In Wisconsin, we compare the responsibility (negligence) for causing the accident to all drivers. If the injured driver is more than 50% responsible there is no recovery. For any driver that is less than 50% the damages are reduced by the percentage of responsibility. For example, if the other driver is 90% at fault and you or a loved one are 10% the court would reduce your damages by 10%. Again, it is very complicated and often times prompt representation can result in obtaining and protecting the evidence used to prove responsibility.
