Car accidents generally happen because of one or more of the drivers’ negligence. Sometimes, there are one car accidents in which the responsibility is with the driver. Unfortunately, even in one car accidents often times passengers are injured.
Many people do not pursue a claim in accident where they were passengers and were injured in a vehicle driven by a family member. Many times, it is a husband or a wife, father or mother of the passengers who are responsible for causing the accident. Truly, this is an unfortunate situation but that does not take away from the fact that people, close family members, may have been seriously injured and those people have a right to recover damages for those injuries.
I have had many cases when a husband and/or wife were driving and their negligence caused the accident and caused injuries to the other spouse. In those situations, the spouse was able to recover for those injuries from the driver’s insurance company. Often, the injured person is also an “insured” under the terms of the policy. Even in those situations, there is insurance coverage to compensate the family member for the damages.
The same is true for children who are injured while passengers in a vehicle driven by one of their parents. Even though the children live with the driver of the vehicle and are in the same house generally, there is insurance coverage to compensate the injured passengers for their injuries. This responsibility lies whether it be a one vehicle accident or a multiple vehicle accident. In multiple vehicle accidents, the passengers may be able to recover from the insurance company for the vehicle, the insurance company for the driver if different than for the vehicle as well as the other vehicle’s driver.
