Over the course of the years, I have represented many victims and their families who were seriously injured or died from adverse reactions to vaccines. Over those years, a common question is:
Under what circumstances may the doctor or person giving me the vaccine or the vaccine maker itself be sued?
Answer: If the Petition has been judged non-compensable or dismissed under then National Vaccine Injury Compensation Program (VICP) or if the award granted by the VICP is otherwise rejected by the petitioner or if the vaccine is not covered under the VICP, in those circumstances suit can be filed.
