You may have seen previous blogs about cases involving injuries caused from vaccines. I have represented both adults and children as well as their families in the Program for over 27 years. Although the Program has been around for many years, many, including medical doctors, do not understand how it works.
The National Vaccine Injury Compensation Program was started in 1986 when Congress decided to develop a Program whereby individuals who have suffered injuries from vaccines could be awarded compensation. The Program was designed to be straightforward and uncomplicated. It was also started to protect vaccine manufacturers from lawsuits and to encourage the development of vaccines without fear of litigation. However, because you have to prove that the vaccine was a cause of your injuries it is extremely difficult and complicated and requires representation by an attorney licensed to practice law in the US Court of Claims of which only a very few, including myself, are allowed.
Claims are filed in the United States Court of Federal Claims in Washington, D.C. Instead of judges, the case is heard by a “Special Master”. Their role is similar to a judge. The Department of Justice and their lawyers represent the Secretary of Health and Human Services who are defending the matter. The Program is funded by the drug manufacturers who contribute money to the fund from each vaccine administered. The Secretary of Health and Human Services, with the help of the Department of Justice, makes sure that they only pay out legitimate claims. The Department of Justice is similar to the attorneys who defend insurance companies in personal injury cases.
If the Special Master finds that the injuries were caused by the claimed vaccine then compensation is awarded for past and future medical needs not covered by insurance, future lost wages as well as past and future pain and suffering.
Not only does the Program pay compensation for damages it also pays your attorney’s fees and costs. There is no financial risk in pursuing legitimate vaccine injury compensation claims.
