VACCINE COMPENSATION LAW: IS THE SWINE FLU VACCINE, H1N1, COVERED IN THE VICP?

VICP (The National Vaccine Injury Compensation Program) was established in 1986 to help compensate vaccine recipients and their families who have been severely injured as a result of adverse effects from certain vaccines. Over the course of the years, I have represented many victims and their families who were seriously injured or died from adverse reactions to vaccines. Over those years, a common question is:

What about the swine flu vaccine, H1N1, is it covered in the VICP?

Answer: Not at this time. In the event you receive only the H1N1 and have an adverse reaction you must file your claim within 1 year of the vaccination and that needs to be filed through the Countermeasures Injury Compensation Program (CICP). The procedure applies except it is in a different program. Again, your attorney’s fees and costs are paid for by Countermeasures Injury Compensation Program (CICP). If there is any concern as to what program to file your claim it is better to file your claim in both programs so you are not prevented for recovery by later finding out you are in the program. Generally you receive the Trivalent Influenza vaccine within weeks or as the same time as the swine flu vaccine. In those cases, although we should discuss your options, we generally file in the VICP.
