Vaccine Injury Law: How Much Will it Cost to Pursue a Vaccine Injury Claim?

Stephanie Thompson, Estate Planning Attorney of Krueger Hernandez & Thompson SC · Nov 29, 2013 ·

Lawyers can be expensive.  Generally, for most legal matters lawyers charge by the hour regardless of the outcome.  In addition to hourly fees there are costs that often times are the client’s obligation.  In some situations and in some types of cases, lawyers charge a contingency fee.  This means that their fees are paid for based upon a percentage of what is ultimately recovered.  Although there are no fees if you lose there may still be costs.

The Vaccine Injury Compensation Program is different.  First, not every lawyer is able to represent you in a Vaccine Injury Compensation claim.  Those that are able, like myself, keep track of all of our time as well as all of the cost incurred on your behalf.  These costs include everything from filing fees to medical records to travel expenses should we have to come visit you or travel for a hearing or to meet with experts, etc.  At the end of your case those fees and costs are submitted to the Program and are paid for by the Program.  This is true even if you do not win the case.

Sometimes, clients advance fees for getting their medical records and in some situations they may even pay the filing fee.  Those expenses are reimbursed by the Program and paid directly to the client.

All of the fees and costs whether reimbursed to you or to your attorney do not come out of your settlement.  Whatever amount you are awarded is your money and is above and beyond the legal expenses.  If we are unable to prove that your vaccine caused your injury you still will be reimbursed your fees and costs and you will not owe anything for legal expenses.  In short, you should never incur any out-of-pocket expenses by pursuing your vaccine injury compensation claim.

Of course, there are always exceptions.  There has to be a reasonable basis for filing your claim.  This should not be a problem because we do not pursue claims that do not have a reasonable basis.  If we are willing to pursue your claim you can rest assured that we have a reasonable basis.

Remember, we represent clients with vaccine injury claims around the country and regardless of where you live you will not incur any legal fees or costs including our travel expenses.

If you or a loved one have had an adverse reaction from a vaccination please immediately contact me for a no cost, no obligation consultation.  There are specific time limitations in bringing these claims and if those time limits are not followed your claim could be dismissed.  This means you will not recover compensation under the Vaccine Injury Program.

Nationwide contact me at (866) 455-2993, in Wisconsin at (608) 824-9540, in the New York City area at (212) 521-4192 or in Illinois contact me at our Chicago office at (312) 988-4830 or.  Of course, please feel free to email me at mark@kh-law.net or check out our website at https://khtlawyers.com.  We are your vaccine injury lawyers!
