Wisconsin Worker’s Compensation Law: Report Your Injury to Employer Immediately

Many of my clients get denied worker’s compensation benefits because they failed to report their injury to their employer in a timely manner. What usually happens is the employer and the insurance company denies the injury because there is not enough proof that an injury happened on the job. The injured employee is then stuck with the bills and fighting to prove that they are entitled to benefits. One way to quickly get the benefits you deserve is to immediately report any injuries that you have on the job.

Problems usually arise when there is an employee who is working a hard manual labor job where aches and pains are common after a long day at work. Many of these employees are stubborn and try to “tough it out” as they have in the past. The pain lingers and then a few weeks later the employee finally goes to the doctor and it is found that a more serious injury is present. The employee then goes back to the employer but the employer denies the injury because there was no injury reported. The employee is then stuck with the bills.

Here are a couple of tips that can help you get the benefits you deserve and quickly:

• If you have an incident that causes immediate pain file an injury report. It might heal on its own but that sprained ankle could be broken or that pop in your shoulder might be a torn rotator cuff.
• If you have a lingering injury that you think is work related be sure to tell your employer as soon as possible. Even if you don’t need medical treatment it puts the employer on notice.
• If you receive medical care be sure to inform the treating practitioner that you believe it is a worker’s compensation injury. Make it clear that you want it known in the medical record that you believe it is a worker’s compensation injury.
• Always ask for work restrictions and have your medical provider list in the work restrictions your limitations and the cause of the injury.
• Don’t ever be fearful of reporting a work related injury. If you get injured on the job you deserve worker’s compensation benefits.
